These Terms & Conditions ("Terms") govern your access to and use of Yiyi, including the website available at yiyi.tandooricornerrestaurant.com, and any related websites, applications, software, tools, features, products, and services that we make available from time to time (collectively, the "Services").
Please read these Terms carefully before using the Services.
By accessing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies incorporated into them by reference.
If you do not agree to these Terms, you must not access or use the Services.
1. About Yiyi
Yiyi is a technology platform that provides users with tools and infrastructure to create, manage, host, publish, organize, and distribute digital content and webpages.
Unless expressly stated otherwise, Yiyi acts solely as a technology and hosting service provider.
We generally do not create, author, edit, endorse, approve, verify, or independently review content published by users of the Services.
The views, statements, information, offers, products, recommendations, and other materials appearing in user-generated content belong solely to the users or third parties responsible for that content and do not necessarily represent the views of Yiyi.
The availability of content through our Services does not constitute an endorsement, sponsorship, recommendation, or guarantee by Yiyi.
2. Eligibility
You may use the Services only if you have the legal capacity to enter into a binding agreement under applicable law.
If you use the Services on behalf of a company, organization, business, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.
You must not use the Services if applicable law prohibits you from receiving or using the Services.
We may impose additional eligibility requirements for certain features, products, jurisdictions, or account types.
3. User Accounts
Certain features may require you to create an account.
When creating or maintaining an account, you agree to provide accurate, current, and complete information and to update that information when necessary.
You are responsible for:
- maintaining the confidentiality and security of your account credentials;
- maintaining control over devices and email addresses associated with your account;
- all activities occurring through your account;
- ensuring that anyone accessing the Services through your account complies with these Terms.
You must promptly notify us if you believe your account has been compromised or accessed without authorization.
We may require additional verification where reasonably necessary to protect users, prevent fraud, comply with applicable law, investigate suspicious activity, or maintain the security of the Services.
We reserve the right to reject registrations, restrict accounts, suspend accounts, or require additional verification where reasonably necessary.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms and any other policies we make available.
You must not use the Services to:
- violate any applicable local, national, or international law or regulation;
- facilitate fraudulent, deceptive, or unlawful activities;
- distribute malware, viruses, malicious scripts, ransomware, spyware, or other harmful code;
- interfere with, disrupt, overload, damage, or impair the Services or infrastructure connected to them;
- attempt to gain unauthorized access to accounts, servers, systems, networks, databases, or other restricted areas;
- probe, scan, test, or circumvent security or authentication measures without authorization;
- impersonate another individual, company, organization, or public authority;
- misrepresent your identity, affiliation, qualifications, or relationship with another person or organization;
- send unsolicited bulk communications, spam, or abusive promotional messages;
- harvest or collect personal information without appropriate authorization or lawful basis;
- violate intellectual property, privacy, publicity, confidentiality, contractual, or other rights belonging to third parties;
- publish content that is unlawful or otherwise prohibited under our applicable policies;
- manipulate the Services in a manner intended to artificially generate traffic, engagement, impressions, clicks, rankings, or other metrics;
- access the Services through unauthorized automated systems where we have prohibited such access;
- resell, reproduce, copy, or commercially exploit the Services except where expressly authorized by us;
- reverse engineer, decompile, disassemble, or attempt to discover the source code of proprietary components of the Services except where applicable law expressly permits it;
- use the Services to develop or train a directly competing product where such use violates these Terms or applicable law.
We may investigate suspected violations and take appropriate action.
5. User Content
"User Content" means text, images, videos, audio, files, webpages, designs, data, links, information, and other materials that users upload, create, submit, store, generate, publish, or otherwise make available through the Services.
You retain ownership of your User Content.
By submitting or publishing User Content through the Services, you represent and warrant that:
- you own the User Content or possess all necessary rights and permissions to use and publish it;
- your User Content does not violate applicable law;
- your User Content does not infringe the intellectual property or other legal rights of another person or entity; and
- your use of the User Content through Yiyi does not violate any contractual obligation applicable to you.
You are solely responsible for your User Content and for any consequences arising from creating, publishing, distributing, or relying upon it.
6. Licence to User Content
To operate the Services, you grant Yiyi a non-exclusive, worldwide, royalty-free licence to host, store, cache, reproduce, process, format, transmit, display, and technically modify your User Content where reasonably necessary to operate, maintain, secure, improve, and provide the Services.
This licence does not transfer ownership of your User Content to Yiyi.
The licence exists only to the extent reasonably necessary to provide and operate the Services or as otherwise permitted by these Terms and applicable law.
Where content has been publicly distributed, cached, backed up, or shared with third parties, copies may remain temporarily available after deletion due to technical, legal, security, or backup requirements.
7. Responsibility for Published Content
Yiyi provides infrastructure that allows users to publish content.
Users are responsible for determining whether their content is accurate, lawful, appropriate, and suitable for publication.
Yiyi does not guarantee the accuracy, reliability, legality, completeness, quality, or usefulness of User Content.
The presence of User Content on Yiyi does not mean that Yiyi has reviewed, verified, endorsed, or approved that content.
Where required or permitted by applicable law, we may investigate reports concerning User Content and take appropriate action.
8. Content Moderation
We reserve the right, but do not undertake a general obligation, to monitor the use of the Services.
We may use automated systems, human review, user reports, or a combination of these methods to identify potential violations.
Where we reasonably believe content or activity violates these Terms, our policies, applicable law, or third-party rights, we may:
- restrict access to content;
- reduce or disable certain functionality;
- remove content;
- prevent publication;
- temporarily suspend an account;
- permanently terminate an account;
- preserve relevant records;
- cooperate with lawful requests from competent authorities.
Our failure to identify or take action against a particular violation does not constitute approval of that activity or a waiver of our rights.
9. Artificial Intelligence Features
Certain Services may include artificial intelligence, machine learning, automated generation, recommendation, summarization, translation, editing, or similar functionality ("AI Features").
AI-generated outputs may contain errors or inaccurate, incomplete, outdated, misleading, inappropriate, or unexpected information.
AI outputs may also resemble content produced by other users or third parties.
Yiyi does not guarantee that AI-generated outputs are unique, accurate, lawful, non-infringing, or suitable for any particular purpose.
You are responsible for reviewing and verifying AI-generated content before publishing, distributing, relying upon, or commercially using it.
You should not rely solely on AI-generated output for legal, medical, financial, tax, safety-critical, or other professional decisions requiring qualified human judgment.
10. Intellectual Property Rights
The Services, including our software, interfaces, designs, layouts, databases, graphics, branding, trademarks, logos, documentation, and technology, are owned by Yiyi or its licensors and are protected by applicable intellectual property laws.
Except for rights expressly granted under these Terms, no rights are transferred to you.
Subject to compliance with these Terms, Yiyi grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Services for their intended purposes.
You may not remove, conceal, or alter copyright, trademark, attribution, or other proprietary notices displayed through the Services.
11. Copyright and Intellectual Property Complaints
We respect intellectual property rights.
If you believe content available through the Services infringes your copyright, trademark, or other intellectual property rights, you may contact us with sufficient information to identify:
- the protected work or right;
- the allegedly infringing material;
- the location of that material;
- your contact information;
- the basis of your claim; and
- any additional information reasonably necessary for us to evaluate the request.
We may remove or restrict access to allegedly infringing content where appropriate.
Repeated infringement may result in account restrictions or termination.
Submitting knowingly false or misleading infringement notices may expose the sender to legal liability.
12. Third-Party Services and Links
The Services may integrate with or contain links to third-party websites, APIs, applications, advertising networks, analytics providers, payment processors, hosting providers, or other third-party services.
Third-party services are operated independently from Yiyi.
We do not control and are not responsible for their availability, security, content, privacy practices, terms, actions, or performance.
Your use of third-party services may be subject to separate terms and privacy policies established by those providers.
You use third-party services at your own discretion and risk.
13. Paid Services
Certain features or Services may require payment.
Before completing a purchase, you will be provided with applicable pricing and billing information.
By purchasing a paid Service, you authorize us or our payment provider to charge the applicable fees, taxes, and other disclosed amounts using your selected payment method.
You are responsible for maintaining accurate billing information.
14. Subscriptions and Automatic Renewal
Some paid Services may be offered on a subscription basis.
Where disclosed at the time of purchase, subscriptions may automatically renew at the end of each billing period unless cancelled before the applicable renewal date.
You may cancel a subscription according to the cancellation options made available through the Services.
Cancellation generally prevents future renewals and does not automatically create a right to a refund for a billing period that has already begun, except where required by applicable law.
15. Refunds
Unless otherwise stated during purchase or required by applicable consumer protection law, payments are non-refundable.
This may include payments for:
- partially used subscription periods;
- unused account time;
- discontinued use initiated by the user;
- account restrictions resulting from violations of these Terms.
Nothing in this section limits mandatory refund or consumer rights that cannot lawfully be excluded.
16. Pricing Changes
We may change prices, subscription plans, feature availability, or billing structures from time to time.
Where reasonably required, we will provide notice before material pricing changes apply to an existing recurring subscription.
Continued use of a paid Service following the effective date of an applicable pricing change constitutes acceptance of the updated price, subject to applicable law.
17. Service Availability and Changes
We continually develop and modify the Services.
We may add, modify, replace, limit, suspend, or discontinue features or portions of the Services.
We do not guarantee that any particular feature will remain available indefinitely.
The Services may occasionally be unavailable because of maintenance, technical failures, security incidents, infrastructure problems, third-party outages, network conditions, or circumstances outside our reasonable control.
18. Backups and Data Loss
Although we may maintain backups for operational purposes, Yiyi is not intended to serve as your sole backup or permanent archival service unless we expressly state otherwise.
You are responsible for maintaining independent copies of important content and data.
To the maximum extent permitted by applicable law, we are not responsible for loss of User Content resulting from user actions, account termination, technical failure, third-party services, security incidents, or circumstances outside our reasonable control.
19. Security
We may implement technical and organizational safeguards designed to protect the Services.
However, no internet-based service or data transmission method can be guaranteed to be completely secure.
You are responsible for using appropriate security measures when accessing the Services, including protecting passwords, maintaining secure devices, and avoiding unauthorized account sharing.
You must not attempt to bypass or interfere with security measures implemented by Yiyi.
20. Privacy
Our collection and processing of personal information is governed by our applicable Privacy Policy.
By using the Services, you acknowledge that information may be processed as described in that policy and as permitted by applicable law.
Where you use the Services to collect personal information from your own visitors, customers, subscribers, or other individuals, you are responsible for complying with applicable privacy and data protection laws.
This may include providing appropriate privacy notices, obtaining legally required consent, and establishing a lawful basis for processing personal information.
21. No Guarantee of Results
Yiyi does not guarantee any particular commercial, financial, marketing, search, advertising, audience, or performance outcome.
In particular, we do not guarantee:
- website traffic;
- search engine rankings;
- advertising revenue;
- audience growth;
- sales or conversions;
- social media engagement;
- publication reach;
- availability through third-party search engines or platforms;
- acceptance into third-party advertising or monetization programs.
Results depend on numerous factors outside our control.
